These Terms of Service ("Terms") apply to your access to and use of the My Guardian Art website, products, personalization tools, previews, digital files, physical products, customer support, and related services (collectively, the "Services"). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree to these Terms, please do not use the Services or place an order.

1. About My Guardian Art

My Guardian Art creates personalized Christian canvas art, framed canvas art, and digital artwork files from customer-provided photos and personalization details. Our products are custom-made and produced through ecommerce, personalization, print, fulfillment, and shipping partners.

2. Eligibility

You must be at least the age of majority in your jurisdiction to place an order. The Services are not intended for children under 13. If you upload a photo that includes a child, you confirm that you are the child's parent or legal guardian or that you have the required permission to use and share that image.

3. Your Uploaded Content

You are responsible for any photo, image, name, date, phrase, instruction, review, or other content you upload, submit, or provide. By uploading content, you represent and warrant that:

  • You own the content or have all necessary rights and permissions to use it
  • You have permission from any person shown or identified in the content, including permission from a parent or legal guardian where required
  • The content does not violate copyright, trademark, privacy, publicity, personality, or other rights of any person or business
  • The content is not illegal, exploitative, abusive, hateful, threatening, defamatory, sexually explicit, or otherwise prohibited
  • The content does not include confidential information you do not have the right to share

You grant My Guardian Art and our service providers a limited license to use, reproduce, process, modify, store, transmit, display, and create derivative works from your uploaded content as needed to provide the Services, create previews, produce your order, deliver digital files, provide customer support, prevent fraud, enforce policies, and comply with law.

We may refuse, cancel, suspend, or remove any order or content that we believe violates these Terms, violates law, infringes rights, creates safety or privacy concerns, or is otherwise inappropriate for our Services.

4. Previews, Personalization, and Customer Approval

Personalized products may include artwork previews before purchase. You are responsible for reviewing the preview and order details before placing an order, including the selected artwork, crop, style, spelling, dates, size, frame, quantity, shipping address, and any other personalization details.

Screen previews can vary from the final printed canvas because monitors, phone screens, browser settings, canvas texture, ink, lighting, wrap/crop, and production processes all affect the final appearance. Small variations in color, brightness, texture, crop, and placement are normal and are not defects.

5. Custom Products and Final Sale

Most My Guardian Art products are personalized and made to order. Once production starts, the physical product generally cannot be canceled, returned, exchanged, or refunded except as described in our Refund Policy or required by applicable law.

6. Digital Image Files

Orders may include a personalized digital image file. For refund allocation purposes, the digital image is valued at $19. Once the digital image has been delivered or made available to you by email, download link, order page, or other digital delivery method, it is a delivered digital good and cannot be returned, canceled, or refunded. If a refund or cancellation is approved for the physical product after digital delivery, the non-refundable $19 digital image value may be retained or deducted from the refund, unless applicable law requires otherwise.

The digital image is provided for personal, non-commercial use only. You may print it for personal use, share it with family, or post it on personal social media. You may not resell, redistribute, license, upload to stock sites, use it in commercial products, claim it as a trademark, or use it for advertising or business purposes without our written permission.

7. Orders, Payment, Pricing, and Promotions

Prices, discounts, shipping costs, taxes, product availability, and promotions may change at any time. We may correct errors, cancel orders, or refuse transactions if pricing, product, shipping, or checkout information is incorrect or incomplete.

You agree to provide accurate billing, shipping, contact, and payment information. You represent that you are authorized to use the payment method provided. Payment processing is handled by Shopify, payment processors, and related third-party services.

Promotional codes, discounts, and free shipping offers may have conditions, expiration dates, destination limits, product exclusions, or order minimums. If promotion terms conflict with these Terms, the promotion terms apply to that promotion.

8. Shipping and Delivery

Shipping and delivery estimates are not guarantees. Current production and shipping information is described in our Shipping Policy. We are not responsible for carrier delays, weather delays, customs delays, failed delivery attempts, theft after delivery, or incorrect addresses entered at checkout.

Risk of loss for physical products passes to you when the product is transferred to the carrier, except where applicable law requires otherwise. We will help review tracking issues when possible.

9. Third-Party Services

We use third-party services to operate the website, process payments, host the store, upload and process images, create personalized previews, store files, produce products, ship orders, send emails and messages, provide reviews, prevent fraud, analyze traffic, and advertise products.

These third parties may include Shopify, payment processors, personalization and image-processing providers, cloud and infrastructure providers, print-on-demand and fulfillment partners, carriers, analytics providers, advertising platforms, email and SMS providers, support tools, review platforms, and other vendors.

Some third parties act as our service providers. Others may operate independently under their own terms, privacy policies, security practices, data retention rules, and legal obligations. By using the Services, you understand that your information and uploaded content may be processed by third-party services as needed to provide the Services. To the fullest extent allowed by law, My Guardian Art is not responsible for third-party outages, errors, delays, policies, security incidents, data practices, or independent uses of information outside our control.

10. Relationship With Shopify

Our store is powered by Shopify. Shopify provides ecommerce hosting, checkout, payments, and related platform services. Purchases made in our store are made directly with My Guardian Art, not Shopify. Shopify may process information according to Shopify's own terms and privacy policies.

11. Product Descriptions and Artistic Content

We try to describe products accurately, but we do not guarantee that product descriptions, images, colors, dimensions, pricing, or other content are error-free. Product images and mockups are examples and may differ from the final personalized product.

Religious, memorial, devotional, or inspirational wording and artwork on the website are artistic expressions. They are not professional counseling, theological advice, legal advice, medical advice, or a guarantee of any spiritual outcome.

12. Intellectual Property

The website, brand name, logos, text, graphics, product designs, product descriptions, page layouts, and other content provided by My Guardian Art are owned by My Guardian Art or our licensors and are protected by intellectual property laws. You may not copy, reproduce, sell, modify, scrape, distribute, or exploit the Services or our content without written permission.

You retain whatever rights you have in the photos and content you upload, subject to the license you grant us to provide the Services. We do not claim ownership of your original uploaded photos.

13. Reviews, Feedback, and Public Submissions

If you submit a review, photo review, testimonial, comment, suggestion, or other public feedback, you grant My Guardian Art permission to use, reproduce, display, edit for length or formatting, publish, and share that feedback in connection with our business, products, website, advertising, emails, and social media. You are responsible for ensuring your review or feedback is truthful and does not violate anyone's rights.

14. Prohibited Uses

You may not use the Services to:

  • Violate any law or regulation
  • Infringe or violate the rights of others
  • Upload content you do not have permission to use
  • Upload illegal, exploitative, abusive, hateful, threatening, defamatory, sexually explicit, or harmful content
  • Impersonate another person or misrepresent your identity
  • Interfere with the security or operation of the website
  • Scrape, copy, resell, or commercially exploit the Services or delivered artwork
  • Submit false, misleading, or fraudulent information

15. Disclaimer of Warranties

Except as expressly stated by My Guardian Art, the Services and products are provided "as is" and "as available" to the fullest extent allowed by law. We do not guarantee that the Services will be uninterrupted, error-free, secure, or that every preview or product will meet your subjective expectations. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.

16. Limitation of Liability

To the fullest extent allowed by law, My Guardian Art and our owners, employees, contractors, service providers, partners, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, replacement costs, emotional distress, or similar damages arising from your use of the Services or products.

To the fullest extent allowed by law, our total liability for any claim related to an order will not exceed the amount you paid to My Guardian Art for the product giving rise to the claim, excluding any non-refundable delivered digital image value, shipping charges, taxes, discounts, and third-party fees.

17. Indemnification

You agree to defend, indemnify, and hold harmless My Guardian Art, Shopify, and our respective owners, employees, contractors, service providers, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your uploaded content, your violation of law, your misuse of the Services, or your violation of another person's rights.

18. Changes to the Services and Terms

We may update, suspend, discontinue, or change any part of the Services or these Terms at any time. Updated Terms will be posted on this page with a new "Last updated" date. Your continued use of the Services after changes are posted means you accept the updated Terms.

19. Governing Law

These Terms and any dispute relating to the Services or products will be governed by the laws of the State of North Carolina, without regard to conflict of law rules, except where applicable consumer protection law requires otherwise.

20. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.
